The first witness called by the state was Brandon Vessels of Grayson Valley who testified to his encounter with Matt Pitt.
Vessels said a neighbor alerted him to a strange vehicle parked in their townhome subdivision and to four wheeler activity in the woods near their home.
Vessels said that when they went to investigate, they saw a rifle and a four wheeler. Pitt and someone named Bailey soon arrived on another ATV to retrieve the rifle and four wheeler. It was at that time, according to Vessels, that Pitt displayed a badge to Vessels and his neighbor.
Vessels testified that he told Pitt the police had been called and that Pitt then took the rifle and left the area on the four wheeler. Vessels testified that he believed Pitt to be a law enforcement officer after seeing the badge.

Vessels also testified he was concerned about drug activity in the area after seeing four young adult males outside of his residence days prior to his encounter with Pitt. He said he saw a glowing glass pipe, but there was no testimony tying Pitt to that incident.
