BIRMINGHAM — The Birmingham Police Department reports that detectives have received a ruling in connection with a homicide investigation. The ruling will cause investigators to reclassify the investigation. The incident occurred on Nov. 22 around 8:15 p.m.
Police said officers from the North Precinct responded to 3191-B 42nd Avenue North to investigate a report of a person shot. Officers arrived and located the subject inside the apartment unresponsive and suffering from a gunshot wound. Birmingham Fire and Rescue arrived along with the Jefferson County Coroner and the victim was pronounced deceased as a result of his injury.
Authorities had identified the departed as Lyndell Miller, a 22-year-old black male, from Birmingham.
After BPD Investigators presented the case to the Jefferson County District Attorney’s Office, it was ruled that the death of Lyndell Miller will be classified as justifiable. No charges will be filed against a suspect.
