MONTGOMERY — Attorney General Steve Marshall announced that on Friday the Alabama Court of Criminal Appeals affirmed the murder conviction of Demetrius Luther Wilbert. Wilbert, 40, of Birmingham, was convicted in Jefferson County Circuit Court in July 2018 for the murder of Nichole Wallace, his ex-wife.
The evidence at trial showed that on or about Oct. 10, 2016, Wilbert violently beat, stabbed and strangled Wallace to death, put her body in the back seat of her car, and burned the car to destroy any evidence.
The Jefferson County District Attorney’s Office prosecuted this case and obtained a guilty verdict. Wilbert was sentenced to life imprisonment without the possibility of parole for his conviction. Wilbert sought to have his conviction reversed on appeal.
The Attorney General’s Criminal Appeals Division handled the case during the appeals process, arguing for the Alabama Court of Criminal Appeals to affirm the conviction. The Court did so in a decision issued Friday, May 17.
Attorney General Marshall commended Assistant Attorney General Thomas Leverette for his successful work on this case.
