TRUSSVILLE — A former Trussville Police officer is charged with custodial sexual misconduct after an alleged incident inside the Trussville City Jail.
The Jefferson County Sheriff’s Office arrested David Wayne Montgomery, 51, of Fultondale and booked him into jail on March 10, 2021. He was released from jail the same day on a $15,000 bond.
Trussville Police Chief Eric Rush said the incident happened in late 2019.
“We were made aware that an incident may have happened inside the jail between Montgomery and a female prisoner,” Rush said. “We initiated an internal investigation and Montgomery chose to resign.”
The Trussville Police Department notified the Attorney General’s Office about the incident and warrants for Montgomery’s arrest were obtained in late February 2021.
Rush said Montgomery worked for Trussville Police for several years before the incident.
If convicted, Montgomery faces a maximum penalty of up to 10 years imprisonment and a fine of up to $15,000 for custodial sexual misconduct, a class C felony.
