JEFFERSON COUNTY, Ala. — A Jefferson County judge has dismissed an ongoing lawsuit challenging Tommy Tuberville’s eligibility to appear on Alabama’s gubernatorial ballot in November.
Ken McFeeters argued that Tuberville did not meet Alabama’s seven-year residency requirement, seeking to have Secretary of State Wesley Allen halt certifying Tuberville as the Republican nominee for the Nov. 3 election.
Circuit Judge Chuck Price dismissed the case without ruling on the underlying residency question.
Judge Price decided that the court lacked the jurisdiction to remove a candidate from an upcoming ballot. He also found that Jefferson County was the wrong venue for McFeeters’ claims against Allen due to the fact the secretary officially resides in Montgomery County.
McFeeters previously challenged Tuberville’s eligibility through the Alabama Republican Party before turning to the courts.
Wednesday, Aug. 19, marks 76 days until the general election and the deadline for a party to choose a replacement candidate if a nominee is removed from the ballot.
